Appeal Update 7, 1/16 & 1/23/04

**Judge C. Alan Lawson's office contacted Alan Yurko's attorney on 12/19/03 to advise him that a hearing has been granted, but that setting the date and venue were still in process. This was unusual, because normally they wait until everything is set before announcing such a decision.

2/7/04: As expected, the State Attorney has requested permission from the Court to conduct a "pre-hearing discovery." This means taking depositions, or statements revealing all Defense's evidence, from Alan's expert witnesses. In turn, Alan's attorney will probably "depose" the State's witnesses. Though it is a valid legal privilege of the Prosecution that the Judge cannot deny, the fact is the State already has all information that could be revealed by such discovery. Since it is also costly, it amounts to a delay-and-drain tactic by the State.

A "case management" hearing has now been scheduled for 26 March 2004 at 1:30 PM, before Judge Alan Lawson in Orlando. Witness lists will be exchanged, and each side will say how long the deposition of witnesses will take. Also to be determined is how long the evidentiary hearing itself will take, so that it can be scheduled properly. All this will allow the establishment of a date for the long-awaited evidentiary hearing. The length of the interim period is unknown, but we are hopeful for an early summer release!

Other matters to be discussed are the permission granted by Judge Lawson for media to bring in cameras; and a Motion for Co-Counsel to allow Alan Yurko to question and cross examine witnesses himself, along with his attorney Loren Rhoton, Esq. of Rhoton and Hayman, PA.
